About a week ago I got a letter from the insurance company stating that I was past due for renewal on my insurance for the Ultra. I called and explained that I had not had an Ultra since they towed the carcass off many months ago. The guy seemed surprised since he saw nothing on his screen about it, but he promised to take care of the problem. Yesteday, I get a check for $525. I called and asked waht that was all about. The girl said that was the balance of my insurance that was cancelled as of 20 April since the bike was a total. The little bell went of fin the head. I told her that was not a good thing because if I can ever get my lawyer off of the dime, there was a good chance I might have to make a claim against my uninsured motorist insurance. If my policy shows cancelled on the day of the wreck, I can imagine their lawyers seizing that as a way to deny me coverage. She promised that they would be calling me today to resolve this.
Meanwhile, I calll my lawyer and find he is in confwerence with a client. I left a message for him to call me ASAP after the meeting for a minute of his valuable time to let him know what was going on and to get a status report since I have not heard from him in 2 months. NO CALL as of this AM. I intend to show up at his office as soon as I get off of work today. May be firing another one today. This is getting rediculous!

He'll gt moving or he'll get fired. I just got off the phone with his secretary and laid out the immediate problem to her. He is in court today so I have to wait until at least Monday to have a meet with him. He had better return my call. I am not a happy camper right now and my patience is GONE!

Usually once you file a clam you get assigned to a "claim adjuster" that is supose to help you deal with all of the issues within the insurance company, find out who your is and start climbing up his ass too!
What insurance comp? I'm getting goood at this :)

Imho all insurance companies are crooks. I've been in several accidents (all of which were not my fault) and I still think I did more run around trying to get everything cleared up. From getting a rental to actually getting compensation for the vehicles.
They love taking your money as long as nothing happens, and it's like pulling teeth when you really need some help. Sorry for the rant, this subject really erks me.
Hope everything gets worked out in your favor KD I feel your pain.

My claim adjuster was in a big hurry to pay me for my bike and get out of the picture. As far as I am concerned, GMAC did everything they could to screw me (which is why I have a lawyer---for whatever he is worth). I have the impression s did my primary witness that they did not believe my story and wanted me to be the bad guy. They did not want to use his statement in their kangeroo court/arbitration but were more than willing to use the witness who has admitted she was not at the scene when the wreck happened. It may well be that they are aware of how much they could potentially owe me above and beyond the money they gave me for the motorcycle and are doing all they can to make me just go away.

Well, progress...got a call from the secretary who says he is still in court, but he wanted me to know he will be calling me either today or if not, by tomorrow even though it will be a weekend. Apparently the little hostile note in my voice earlier today got someone's attention. And you're right, Bob, I ain't a'goin' nowhere!

Take a deep breath and keep your head straight on the goal you have.
This is the american way. To slow everything down to a crawl and hope that it gets tried of waiting. If you have the patients needed you'll come out of this fine.
Yes keep the fire in the laywers pants lite. If you change laywers midstream it could harm your case.

Well, here it is 1:05 P.M. and I called this moring around 9 to request he call. I was assured he would, but nothing yet. I hope he isn't pissed off when I show up at his office this afternoon with some of that Cajun fire in my eyes.

I went to his office after work and of course he was in his office on the phone. I got the secretary to go in and disturb him. He sent a message out to tell the secretary what I needed to know and he would definitely call me after he got finished with his client of the moment with the info. BTW, she said he had all of the notes from me to call in front of him, and he was returning calls at that moment. I told her I wanted a complete status report. Of course here it is the next day and I am still waiting for the call. this AM, I intend to call and make an appointment to sit across the table ith him ASAP. At this time, I am ready to go to war. If I was the suspicisous sort, I'd think I was getting the run-around!

I think I would have sat in his office until he left work and then tied him to his chair. The guy at least owes you an explanation why nothing has been done Daryll. Your restraint is commendable and I hope you get something accomplished during your eyeball with him.

I am just perplexed and disgusted as to why I can't seem to get any action on what I think is a slam-dunk case. It's like no one seems to care, no one wants to make a move. The insurance companies are laughing all the way to the bank!

I don't know how much he will make off of your case, but he might be trying to work on cases that will make him more $$$ and let yours slide to the back burner........I wouldn't put it past a lawyer to do just that.

This whole thread makes me sad ... and happy that I no longer work in a law firm. I used to be the one having to fend off and appease angry clients when the attorney didn't return calls or keep his clients up to date on any activity, even when the clients were absolutely right to be frustrated and furious.
Stay on him for regular progress reports. Unless he's really an incompetent (not just uncommunicative) attorney, it would be in your best interest to stay with him instead of going to a different attorney.
I apologize for being out of the loop - you probably said elsewhere and I missed it, but does your claim involve personal injury or just property damage? Personal injury claims can take a while to resolve (unless the insurance company convinces you to settle early, which usually isn't to your advantage), but property damage alone should be pretty cut and dried. It is what it is, and there's not much room for negotiating.

This involves both a totally destroyed Ultra and a pretty messed up leg for the BI part. Allstate (the carrier of the enemy) has pretty much blown me off and refuses to comunicate with me. My insurance is not much better although they did give me nearly $19K for the Ultra with which I had to pay off the balance of the hospital and all of the other medical crap my medical insurance dumped on me. Allstate has refused to communicate with Blue Cross...that's pretty arrogant. They seem to be basing their claim of me at fault on a witness who has admitted she was not at the scene until nearly 20 minutes after the actual wreck. My witnesses do not seem to count as far as they are concerned. As for the lawyer, he will make a lot of money if he does his job. I just do not understand the runaround. This is approaching 1 year...man time flies when youre having so much fun!

I have been trying to get a lawyer to file a suit since last May. It is now 11 months and not one scrap of paper has been filed on my behalf. I'm beginning to wonder if this B!T(# is screwing every lawyer in town.

They typically don't file suit until the statute of limitations is about to run. It costs less for everyone if it can be settled out of court.
Once a suit is filed, you're going to be dealing with the whole discovery process, expert witnesses, most likely undercover surveillance, all of which will weigh heavily on the outcome, and the plaintiff's attorney gets a bigger portion of the judgment than he would if it settles without having to file suit. But judgments, if one is awarded, tend to be a little higher. It's a gamble.
The whole legal process is a bitch. But sometimes it has to be done.

Well, it took over a week, but I finally got the shyster on the phone a few minutes ago. He says he is being stonewalled by Allstate. I asked him why he doesn't just tell them to $#!T or get off the pot because paper is on the way. He finally conceded that he will have to give them a "drop dead date", but warned that because of all of the BS manuevering that is always done in these cases that this will not be a quick thing. I told him that why should I be concerned with delaying tactics since it only took 11 months to convince someonw to file a damned suit as I asked for back when the accident happened, and that still has not happened. So it looks like I finally have gotten some movement, but it may be a long time before I see my new Ultra.
As for the fees, he gets 33% regardless, so let's see if he is worth all of this crrap. I think he is fully aware now that I am one very angry white boy and not going to roll over and play dead for these SOB's.
I'll just have to hope now that I can convince my brother to let me get his RK running so I can at least do some riding this summer. I wonder how that will look if they hire detectives to follow me around. Guess I'll have to get one of those folding canes like Jim has.

Those Fu**ing detectives suk*ss big time. I was allowed to ride by my doctor after my back injury and those mothers taped me doing it and when I went to court my doctor would not put that comment into writting so I lost big time.

Well, I figure after a year, I am allowed some degree of healing with the stipulation that it hurt like hell during the process. I don't have a bike to ride anymore, so they can't get that. I am too old for playing football, and sitting on my big John Deere probably isn't a bad deal either. I usually use a cane in public, so take all the pix in the world, it shows I am incapacitated as I was NOT before. They would literally have to come onto my property to get a shot of me doing anything here because the property is surrounded by woods and greenery, and if they come onto the land, they run a real risk of getting accidentally shot or deliberately arrested.
